GeniusWP is a brand operated by Aspira Technologies, having its business address at 438, Om Nagar, Nagpur – 440009, Maharashtra, India. In this Disclaimer, “GeniusWP”, “Aspira Technologies”, “we”, “us” and “our” refer to Aspira Technologies operating under the GeniusWP brand.

Please read this Disclaimer together with our Terms and Conditions, Privacy Policy and Refund and Cancellation Policy. If a product page contains specific information about a product’s license, activation method, validity, website limit, updates or support, that product-specific information also applies.

1. General Information

We make reasonable efforts to keep the information on the Website accurate, complete and current. However, Website content is provided for general product, purchasing and support information. It should not be treated as a promise beyond the express description, entitlement and terms displayed for the relevant product at the time of purchase.

Product features, interfaces, versions, screenshots, documentation, pricing and compatibility may change because of updates made by the original developer, WordPress, WooCommerce, hosting providers or other third parties.

2. Independent Business and No Implied Affiliation

GeniusWP is an independent business operated by Aspira Technologies. Unless expressly stated on a product page, GeniusWP and Aspira Technologies are not the original developers, trademark owners, official distributors, authorized representatives, partners, affiliates or employees of the third-party product developers whose products are identified on the Website.

The listing, comparison, description or sale of access to a third-party product does not by itself mean that the original developer sponsors, endorses or is affiliated with GeniusWP.

3. Third-Party Names, Logos and Trademarks

WordPress, WooCommerce, Elementor, Rank Math and all other third-party product names, company names, logos, icons and trademarks are the property of their respective owners. They are used on the Website only where reasonably necessary to identify, describe or explain compatibility with a product or service.

The WordPress name and logo are trademarks controlled by the WordPress Foundation. GeniusWP is not part of, sponsored by or endorsed by the WordPress Foundation or the official WordPress project.

Nothing on the Website grants a customer ownership of a third party’s trademark, brand, source code, documentation or other intellectual property. Customers must comply with the applicable software license and any lawful product-specific restrictions.

4. Product Ownership and Licensing

Purchasing through GeniusWP does not transfer ownership of the underlying third-party software or intellectual property. The customer receives only the download, license access, activation service, update entitlement and support expressly stated on the applicable product page or order confirmation.

Third-party software may be governed by an open-source license, an end-user license agreement, the original developer’s service terms or a combination of them. Nothing in this Disclaimer restricts a right that an applicable open-source license or mandatory law gives to the customer. Access to the original developer’s account-based services, cloud features, template libraries, artificial-intelligence credits, premium support or future updates is included only when expressly stated.

5. License-Key Products and Assisted-Activation Products

GeniusWP may offer different delivery or activation methods depending on the product:

• License-key delivery: A license key or activation detail may be supplied where this is expressly stated on the product page.

• Assisted agency activation: For certain products, GeniusWP may activate the product on an eligible customer website using an agency, business or multi-site subscription held or managed by Aspira Technologies. In this case, no separate license key, developer-account credential or master subscription access will be provided or disclosed to the customer unless the product page expressly says otherwise.

An assisted activation is a limited service for the purchased product and submitted domain. It does not transfer our subscription account or create a direct contractual relationship between the customer and the original developer. Availability remains subject to the applicable subscription terms, activation limits and policies of the original developer. If an assisted activation cannot lawfully or technically be provided as described, we will offer an appropriate remedy under our Refund and Cancellation Policy and applicable law.

6. Temporary Website Access for Assisted Activation

Where assisted activation is offered, the customer may be asked to provide temporary, revocable access to the relevant WordPress website after the order is verified. The customer must be the website owner or otherwise have authority to grant that access.

Our team will use the temporary access only for the stated installation or license-activation request. Unless the customer separately authorizes and purchases another service, we will not intentionally edit pages, posts, designs, customer content, unrelated plugins, business settings or other website material. A strictly necessary technical change made solely to complete the requested installation or activation may be performed only within the disclosed service scope.

The customer should:

• Create a current website and database backup before granting access;

• Use a temporary administrator account or a securely generated expiring login link where possible;

• Avoid sending permanent hosting, payment, banking or unrelated account credentials;

• Remove or revoke the temporary access promptly after completion; and

• Change any password that was shared for the temporary task.

No payment card number, CVV, UPI PIN, OTP or banking password is required for activation support. Our handling of order information and temporary access details is explained in our Privacy Policy.

7. License Validity, Updates, Renewal and Deactivation

License validity, website limits, updates, renewal, support and domain-change conditions are product-specific. A purchase does not include lifetime activation, lifetime updates or lifetime support unless the product page expressly and unambiguously states this.

An original developer may change its plans, activation system, prices, features, technical requirements or service availability. GeniusWP does not control those decisions. We will honor the entitlement expressly sold by us, subject to our Terms and Conditions, Refund and Cancellation Policy and applicable law, but we cannot guarantee that a third party will maintain a particular feature or commercial plan forever.

A license or activation may be suspended or deactivated after expiry, refund, payment reversal, confirmed fraud, prohibited sharing, use beyond the purchased website limit or another material breach of the applicable terms.

8. Compatibility and Technical Environment

We do not guarantee compatibility with every hosting provider, server configuration, WordPress or PHP version, theme, plugin, browser, custom codebase or future third-party update. Customers should review the stated requirements and compatibility information before purchasing.

A product may behave differently because of hosting restrictions, outdated software, malware, caching, security rules, custom code or conflicts with another theme or plugin. A compatibility issue caused by an environment outside our control does not automatically mean that the supplied product or activation is defective. Genuine non-delivery, invalid activation, a material defect or a product materially different from its description will be handled under our Refund and Cancellation Policy and applicable consumer law.

9. No Guarantee of Business or Performance Results

Themes, plugins, SEO tools, page builders, performance tools and other digital products are tools only. We do not guarantee that using any product will produce a particular search ranking, traffic level, revenue, profit, conversion rate, website speed, security score, accessibility result or business outcome.

Results depend on many factors outside our control, including the customer’s content, implementation, hosting, competition, advertising, search-engine changes, technical maintenance and legal compliance. Any example, screenshot, demonstration, review or testimonial describes a particular experience and is not a guarantee that every customer will receive the same result.

10. Support Scope

GeniusWP support is limited to the scope stated on the relevant product page or support plan. Unless expressly included, support does not cover custom development, website design, content creation, server administration, malware removal, repair of unrelated code, full website maintenance or changes to third-party products.

Support from GeniusWP is separate from direct support provided by an original developer. A customer will receive original-developer support, account access or cloud services only when that entitlement is expressly included in the product description.

11. Website Content Is Not Professional Advice

Articles, tutorials, comparisons, product descriptions, setup guidance and support information on the Website are provided for general informational purposes. They are not legal, tax, accounting, financial, cybersecurity or other regulated professional advice.

Customers remain responsible for evaluating whether a product and its use are suitable for their business, website, users and legal obligations. Where professional advice is required, customers should consult an appropriately qualified adviser.

12. Payments and Payment Gateways

Payments may be processed through third-party payment service providers, including Cashfree Payments and Stripe. These providers facilitate payment processing and may conduct their own security, fraud-prevention or compliance checks under their respective terms and privacy notices.

Cashfree and Stripe are not the sellers or developers of GeniusWP products and do not decide product delivery, support scope or refund eligibility. Order, delivery, activation and refund questions should first be directed to GeniusWP. Approved refunds will be handled in accordance with our Refund and Cancellation Policy and the processing rules of the applicable payment provider and financial institution.

13. External Links and Third-Party Services

The Website may link to original-developer websites, documentation, hosting providers, community platforms, payment services or other third-party resources. A link is provided for convenience or reference and does not automatically mean that we control, approve or guarantee the third party’s content, availability, security or practices.

Customers should review the terms, privacy notices and security practices of a third-party service before using it or providing information to it. This section does not reduce our responsibility for a product or service directly sold by us or any liability that cannot lawfully be excluded.

14. Customer Responsibility, Backups and Security

Customers are responsible for maintaining lawful website content, secure credentials, updated software and appropriate backups. Before installing, activating or updating a theme or plugin, customers should create a complete backup and, where practical, test the change on a staging website.

No online system or software product can be guaranteed to be completely secure, uninterrupted or error-free. Customers should follow reasonable security practices and promptly report suspected unauthorized account or license activity to us.

15. Errors, Availability and Changes

Although we use reasonable care, the Website may occasionally contain a typographical, pricing, version or technical error. We may correct an error and update or remove content. If a material error affects an order already placed, we will inform the customer and provide an appropriate correction, cancellation, replacement or refund where required.

Where liability may lawfully be limited, our total aggregate liability relating to a particular order will not exceed the amount actually paid to us for the affected product in that order.

These limitations do not apply to fraud, wilful misconduct, gross negligence, breach of a non-waivable statutory duty or any other liability that cannot lawfully be excluded or limited.
